Lemlii Privacy Policy and Terms of Use
Privacy Policy
Introduction
Welcome to Lemlii! We are committed to protecting your privacy and complying with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our website, application, and any related services (collectively, the “Service”). Please read this policy carefully. If you do not agree with its terms, please do not use Lemlii.
We may update this Privacy Policy from time to time. If we make changes, we will update the “Last Updated” date and, if changes are significant, provide notice via the Service. Continued use of Lemlii after we post an updated Privacy Policy means you accept those changes.
Information We Collect
-
Personal Data: When you register for an account or interact with Lemlii, we collect personal information such as your name, email address, and (if applicable) mailing address or contact details. We may also collect payment information when you subscribe to a paid plan (handled securely via our payment processor). This personal data is necessary for creating your account, providing the Service, and communicating with you.
-
Non-Personal Data: We automatically collect certain technical information about your use of Lemlii. This includes log data like your IP address, browser type, device information, operating system, and browsing actions on our site. This information does not directly identify you and is used to analyze trends, administer and improve the Service.
-
Cookies & Similar Technologies: Lemlii uses cookies and similar technologies primarily for essential functionality (for example, to keep you logged in and remember your preferences). We do not currently use any analytics or advertising cookies that track you across sites. Under European law, we must obtain your consent before using any non-essential cookies. If in the future we introduce cookies that require consent, we will inform you and implement a cookie consent banner. (For now, you will not see a cookie banner on Lemlii because we do not use tracking cookies.)
How We Use Your Information
We use personal data for the following purposes:
-
To Provide and Maintain the Service: We process your information to create and manage your account, authenticate you when you log in, and provide the features of Lemlii. For example, we use your name and email to identify you and communicate service-related information (like changes or technical notices).
-
To Personalize and Improve the Service: We may use data about how you use Lemlii to customize your experience and to develop new features or enhancements. This helps us understand what is working well and what can be improved.
-
For Customer Support: If you contact us for help, we will use your information to respond to and resolve your queries or issues. This may include accessing your account with your permission to troubleshoot problems.
-
For Security and Fraud Prevention: We use information to monitor for and prevent fraudulent, unauthorized, or illegal activity on the Service. This includes efforts to detect security breaches, enforce our Terms of Use, and protect the rights and safety of Lemlii, our users, and the public.
-
To Communicate with You: We will send essential communications about your account or transactions (for example, password resets, service updates, or policy changes). These are not marketing messages but necessary information for all users.
-
For Marketing (with Your Consent): If you have given us your consent (for example, by opting in at sign-up), we will use your email to send you newsletters, product updates, or promotional offers. You are free to withdraw your consent at any time – every marketing email will contain an “unsubscribe” link, or you can contact us to opt out.
Lawful Bases for Processing
We only collect and process your personal data when we have a valid legal basis under the GDPR. (The GDPR requires us to inform you of the lawful grounds for our data processing.) Depending on the context, Lemlii relies on the following bases:
-
Consent: We will ask for your consent before processing your data in cases where consent is required. For example, we rely on consent to send marketing emails or to use non-essential cookies (should we employ them in the future). You have the right to withdraw consent at any time.
-
Contractual Necessity: When you sign up and accept our Terms, a contract is formed between you and Lemlii. We process your personal data as needed to perform this contract – for instance, to provide the Service you requested, manage your account, and fulfill our obligations to you.
-
Legitimate Interests: We may process your data for purposes that are in our legitimate interests (or those of a third party), provided such processing does not override your rights. For example, we have a legitimate interest in improving our product, ensuring IT security, and communicating with you about updates to the Service. We always consider your rights and will honor objections (see “Your Rights” below) in such cases.
-
Legal Obligation: In some cases, we need to process and retain your data to comply with laws or regulations. For instance, we may need to keep transaction records for tax or accounting purposes, or disclose information if required by a court order or regulatory authority.
International Data Transfers
Lemlii is a Canadian company and operates from Canada. If you are located in the European Economic Area (EEA) or United Kingdom, please be aware that your personal data will be transferred outside of Europe, including to Canada and the United States. Canada is recognized by the European Commission as providing an adequate level of data protection for personal information handled by private organizations under its law. This means that transfers of EU users’ data to Lemlii in Canada are permitted under GDPR.
However, some of our data (including video content that you upload) is stored on servers located in the United States. The US is not currently covered by an EU adequacy decision, so we take additional steps to protect EU personal data transferred there. In particular, we have implemented the European Commission’s Standard Contractual Clauses (SCCs) for data transfers with our US-based service providers. SCCs are legal agreements that bind the recipient of the data to uphold GDPR-level privacy protections. This ensures that your information remains safeguarded to European standards even when stored or processed in the US.
By using Lemlii, you acknowledge that your data may be transferred internationally as described above. We will always take appropriate measures to protect your information during such transfers, including robust encryption in transit and at rest, and contractual commitments from our vendors to protect your data. If you have questions about our international data transfer practices, please contact us (see “Contact Us” below).
Third-Party Service Providers (Processors)
We use certain trusted third-party companies to help us provide the Service. These third parties act as data processorswho process personal data on our behalf and under our instructions. We only share the information necessary for them to perform their specific services, and they are not allowed to use your data for their own purposes. Our key service providers include:
-
Bubble: Our application is built on the Bubble platform (a web application development service). Bubble processes user data (such as what you input into the app and database) in order to host and run the Lemlii application. Bubble’s servers may be located in the United States or other locations.
-
Wasabi: We use Wasabi (a cloud storage provider) to store user-uploaded video content and related data. Wasabi’s storage servers for our data are located in the United States.
Each of these providers might process or store personal data (for example, video files, account information) as part of delivering their service to us. We contractually require all our processors to safeguard your data and keep it confidential. Currently, Lemlii is in the process of formalizing Data Processing Agreements (DPAs) with all third-party processors, including Bubble and Wasabi, to meet the requirements of GDPR Article 28gdpr.eu. These agreements will ensure, in writing, that our partners protect your information to GDPR standards, implement adequate security measures, and only process data according to our instructions. We will take prompt action to address any compliance gaps in this area. (In the meantime, we have terms of service in place with these providers and trust their publicly stated commitments to data protection.)
Aside from the processors above, we do not share or sell your personal information to third-party companies for their own marketing. We may share data with other parties only in the following situations:
-
Legal Requirements: If required to do so by law or legal process, or if we have a good-faith belief that disclosure is necessary to comply with a legal obligation, we may share your information. This could include responding to lawful requests by public authorities (e.g., for national security or law enforcement purposes).
-
Business Transfers: If Lemlii is involved in a merger, acquisition, sale of assets, bankruptcy, or other business transaction, user information (including personal data) may be transferred to a successor or affiliate as part of that deal. In such cases, we will ensure the new owner honors the protections required by this Privacy Policy.
-
Enforcing Rights and Safety: We may disclose data if necessary to protect and defend the rights, property, or safety of Lemlii, our users, or others. For example, we might share information with fraud prevention services or investigate violations of our Terms of Use.
-
With Your Consent: We will share your personal data with other parties outside of Lemlii and our processors only when we have your explicit consent to do so. For instance, if you link Lemlii with another service or ask us to share data with a third-party application, we will do so with your direction.
Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. In general, this means we will keep your data for as long as you maintain an account with Lemlii or as long as we are providing the Service to you. If you delete your account or request deletion of your data, we will erase or anonymize your personal information within a reasonable timeframe, except for any data we are required to keep by law or for legitimate business purposes.
For example, we may need to retain certain information for recordkeeping/administrative purposes or to comply with our legal obligations (such as tax and accounting requirements). We also maintain backup copies for a limited period for continuity in case of data loss. When we no longer have a lawful reason to keep your data, we will securely delete or anonymize it.
Data Security
Lemlii employs a variety of security measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. These measures include encryption of data in transit (e.g., using SSL/TLS for our website) and at rest, firewalls and access controls on our servers, and regular security assessments of our systems. We also limit access to personal information strictly to those Lemlii personnel and contractors who need it to operate or support the Service.
Importantly, we will only access the content of your user account with your explicit permission (for example, when you request technical support) or if required by law. All such administrative access to user data by our team is logged and monitored. We maintain internal policies to ensure that any staff access to personal data is handled confidentially and only for the purposes described in this policy.
Please note that while we strive to protect your data, no website or Internet transmission is completely secure. We cannot guarantee absolute security of information. However, we will promptly notify you and the appropriate authorities of any data breaches as required by law.
Your Rights Under GDPR
If you are located in the EEA, UK, or another jurisdiction with similar data protection laws, you have certain rights regarding your personal data. Lemlii is committed to honoring these rights. Under the GDPR, your rights include:
-
Right to Information: The right to be informed about the collection and use of your personal data. We fulfill this through this Privacy Policy and related communications.
-
Right of Access: You can request a copy of the personal data we hold about you, as well as information on how we process it. We will provide this information, free of charge, within the legally required time frame.
-
Right to Rectification: If any of your personal information is inaccurate or incomplete, you have the right to request that we correct or update it. You can also correct some of your information directly through your account settings.
-
Right to Erasure: Also known as “the right to be forgotten,” this allows you to request deletion of your personal data. You can ask us to delete your information, and we will do so, provided we do not have a legal obligation or overriding legitimate interest to retain it.
-
Right to Restriction of Processing: You have the right to request that we limit the processing of your personal data in certain circumstances – for example, if you contest the accuracy of the data or object to our processing, we may restrict use of your data while your request is being resolved.
-
Right to Data Portability: You can request to receive the personal data you have provided to us in a structured, commonly used, and machine-readable format. You also have the right to have this information transmitted to another service provider, where technically feasible.
-
Right to Object: You may object to our processing of your personal data when we base it on legitimate interests, including profiling, or when we are using your data for direct marketing. If you object, we will stop processing your information for that purpose unless we have compelling legitimate grounds to continue or it is needed for legal claims.
-
Right not to be Subject to Automated Decision-Making: You have the right not to be subject to decisions that produce legal or similarly significant effects on you based solely on automated processing (without human involvement). Lemlii does not currently use automated decision-making or profiling in a way that has such effects. In the event we ever implement automated decision processes, we will ensure you have the opportunity to request human intervention or to contest any such decision.
In addition to the above, you have the right to withdraw consent at any time where we are processing your data based on your consent. For example, you can withdraw your consent to marketing emails by unsubscribing or contacting us. Withdrawal of consent will not affect the lawfulness of any processing we conducted prior to your withdrawal.
You also have the right to lodge a complaint with a Data Protection Authority (DPA) or supervisory authority in your country if you believe that we have infringed your privacy rights. We kindly ask that you contact us first so we can address your concerns, but you are entitled to contact the authority directly.
To exercise any of your data subject rights, please contact us using the information in the “Contact Us” section below. We may need to verify your identity before acting on your request, to ensure the security of your account. We will respond to valid requests as soon as possible, and in any event within one month, as required by the GDPR. There is no fee for making a request, unless it is manifestly unfounded or excessive, in which case we may charge a reasonable fee or decline to comply (as permitted by law). We will inform you of any such decisions and your rights in that event.
Contact Us (Data Protection Officer)
If you have questions or requests regarding this Privacy Policy or your personal data, you can contact us at privacy@lemlii.com.
Lemlii is headquartered in Canada, and we have designated our co-founder Lucas Bulger to oversee data protection compliance. You may address any correspondence to him at the email above. Alternatively, you can write to us at: Lemlii Inc., Guelph, Ontario, Canada.
We value your privacy and will be happy to answer any questions or concerns you have about how we handle your data.
Terms of Use
Acceptance of Terms
By accessing or using the Lemlii Service, you agree to be bound by these Terms of Use (“Terms”). The Service includes our websites (such as lemlii.com and mylemlii.com), mobile applications, and any products or services provided by Lemlii. If you do not agree to these Terms, you must not use Lemlii.
Please also review our Privacy Policy above, which describes how we handle your personal data. Your acceptance of these Terms also signifies your understanding of the Privacy Policy.
1. Legal Compliance
You agree to use Lemlii in compliance with all applicable local, state/provincial, national, and international laws and regulations. This includes, without limitation, laws regarding data privacy, intellectual property, export control, and the transmission of technical or personal data. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.
2. Content Responsibility
You are solely responsible for any content that you create, upload, post, send, or display on or via Lemlii. This includes videos, images, text, and any other material (collectively, “User Content”) that you submit to the Service. You warrant that you have all necessary rights to share such content and that doing so does not violate any laws or infringe the rights of any third party.
Lemlii does not claim ownership of your User Content; you retain all rights to the content you post. However, by submitting content, you grant Lemlii a worldwide, non-exclusive, royalty-free license to use, reproduce, and display your content for the purpose of operating and providing the Service. You agree that we act only as a passive conduit for the online distribution and publication of your content. We are not liable for any statements or representations in your content provided by you.
3. Prohibited Uses
You agree that you will NOT use Lemlii (nor permit anyone else to use your account) to engage in any of the following activities:
-
Illegal or Harmful Content: Transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or otherwise objectionable or prohibited by law.
-
Harm to Minors: Exploit or harm minors in any way, including exposing them to inappropriate content or soliciting personal information from anyone under the age of 18 in violation of applicable law.
-
Impersonation and Misrepresentation: Impersonate any person or entity (including, but not limited to, a Lemlii official, employee, or moderator), or falsely state or misrepresent your affiliation with a person or entity.
-
Interference with Service: Forge headers or otherwise manipulate identifiers to disguise the origin of any content transmitted through the Service, or interfere with or disrupt the Service, servers, or networks connected to the Service. This includes distributing any malware, viruses, worms, or other harmful code.
-
Unauthorized Access or Use: Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any computer systems or networks connected to Lemlii, through hacking, password mining, or any other means.
-
Unlawful or Unlicensed Content Sharing: Upload, post, or transmit any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, or proprietary and confidential information learned under nondisclosure agreements).
-
Intellectual Property Infringement: Upload, post, or transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
-
Spam and Unauthorized Promotions: Transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” pyramid schemes, or any other form of solicitation.
Lemlii reserves the right (but has no obligation) to remove or block any content and to suspend or terminate accounts that violate these rules. We may also cooperate with law enforcement authorities and provide information as legally required to assist with investigations of prohibited activities.
4. Account Access by Lemlii
Your privacy is important to us. Lemlii staff will only access your account or User Content with your express permission, or as required by law. For example, if you request technical support and grant us temporary access to your account to resolve an issue, we may log into your account to troubleshoot. Any such administrative access by our team is documented and limited to the necessary scope. We will never view or disclose your private content to others except as described in our Privacy Policy or required by law.
5. Limitation of Liability
To the maximum extent permitted by law, Lemlii and its affiliates, officers, agents, employees, and partners shall not be liable to you for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses. In no event will Lemlii (or its directors, employees, or agents) be liable for any damages whatsoever resulting from:
-
errors, mistakes, or inaccuracies of content on the Service;
-
personal injury or property damage of any nature whatsoever resulting from your access to or use of the Service;
-
any unauthorized access to or use of our servers and/or any personal information stored therein;
-
any interruption or cessation of transmission to or from the Service;
-
any bugs, viruses, malware, or other harmful code that may be transmitted to or through the Service by any third party;
-
or any errors or omissions in any content, or any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via Lemlii.
This limitation of liability applies regardless of the legal theory under which such losses are claimed, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain liabilities (such as liability for gross negligence or willful misconduct), so some of the above limitations may not apply to you. In such jurisdictions, Lemlii’s liability will be limited to the fullest extent permitted by applicable law.
6. Indemnification
You agree to defend, indemnify, and hold harmless Lemlii, its parent company, subsidiaries, affiliates, and their respective officers, directors, employees, and agents, from and against any and all third-party claims, demands, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
-
content you submit, post, transmit, or otherwise make available through the Service;
-
your use of, or connection to, the Service;
-
your violation of these Terms;
-
or your violation of any rights of another person or entity.
We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You agree to cooperate with our defense of such claim and not to settle any such matter without the prior written consent of Lemlii.
7. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever. This includes, without limitation, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.
All provisions of these Terms which by their nature should survive termination shall survive (including, without limitation, ownership of content, warranty disclaimers, indemnification, and limitations of liability). Termination of your account will not relieve you of any obligation to pay any fees or charges accrued prior to termination, and it will not limit any of Lemlii’s other rights or remedies at law or in equity.
8. Refund and Cancellation Policy
You may cancel your Lemlii subscription at any time. If you cancel, your account will remain active with premium features until the end of your current paid billing period (for example, the remainder of the month or year you have already paid for), and you will not be charged again after cancellation.
No Prorated Refunds: Lemlii does not provide refunds or credits for any unused portion of a subscription period. For example, if you purchase an annual plan and decide to cancel after nine months, you will retain access to premium features for the remaining three months of your subscription, but you will not receive a refund for the unused months. We encourage you to enjoy the service for the full duration of the period you’ve paid for, even if you decide not to renew.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction of Lemlii’s incorporation (the Province of Ontario, Canada, and the federal laws of Canada applicable therein), without regard to its conflict of law principles. You agree that any dispute or claim arising out of or in connection with these Terms or your use of the Service shall be brought in the courts of competent jurisdiction located in Ontario, Canada, except where prohibited by applicable law. You expressly consent to the personal jurisdiction of such courts and waive any objections to such venue.
10. Changes to Terms
Lemlii reserves the right, in our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide you with at least 30 days’ notice prior to the new terms taking effect, by posting the revised Terms on our website or by sending a notification via email. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the updated terms, you must stop using the Service before the changes take effect.
11. Contact Information
If you have any questions, concerns, or feedback regarding these Terms of Use, please contact us at support@lemlii.com. We are here to help and will gladly clarify any provisions of these Terms. Your understanding of your rights and obligations under these Terms is important to us, and we encourage you to reach out if you need any assistance.
Thank you for using Lemlii!
